Service agreement for Connected Heart Healing clients

These Terms & Conditions ("Terms") form the service agreement between you ("the client") and Connected Heart Healing (ABN: 95679883607), operated by Jodie Cruz as a sole trader registered in South Australia, Australia ("Connected Heart Healing", "we", "us", "our").
Please read these Terms carefully before booking a service. By making a booking or purchasing a session package or gift card, you agree to be bound by these Terms. If you do not agree, please do not proceed with a booking.
These Terms apply to all Connected Heart Healing services: distance energy healing sessions for people, distance energy healing sessions for animals, session packages, and gift cards.
Note: Quantum-Touch Level 1 workshops and Healing Circles are governed by the Quantum-Touch Organisation's own fees and cancellation policy, not these Terms. Please review the QT policy at: quantumtouch.com/en/workshops/workshops-fees-and-policies before registering for a workshop or Healing Circle.
1. Our services
Connected Heart Healing offers the following services:
Distance energy healing sessions for people — one-to-one sessions of 60 minutes, conducted remotely via video or phone call, incorporating a check-in, energy work, and a post-session debrief
Distance energy healing sessions for animals — one-to-one sessions of 60 minutes, conducted remotely via video or phone call, incorporating a check-in, energy work on your animal in their own environment, and a post-session debrief
Session packages — prepaid bundles of three or five sessions purchased at a discounted rate, subject to expiry terms set out in Section 5
Gift cards — prepaid gift cards for one session, redeemable by the recipient, subject to the terms set out in Section 6
All sessions are conducted entirely online. No in-person sessions are offered. Sessions are available to clients throughout Australia and internationally.
Energy healing is a complementary practice. It is not a substitute for medical or veterinary diagnosis, treatment, or advice. Please see the Health & Medical Disclaimer on our website for full details.
2. Bookings
All bookings are made through Acuity Scheduling, accessible via the booking page on this website. By completing a booking, you confirm that you have read and agree to these Terms.
A booking is confirmed when you receive a confirmation email from Acuity Scheduling. Please check your confirmation email carefully and contact us promptly if any details are incorrect.
You are responsible for ensuring your technical setup (device, internet connection, video or phone access) is working before your session. We are not responsible for sessions that cannot proceed due to technical issues on your end. Where possible, we will make reasonable efforts to reschedule.
Session times are displayed in your local time zone within Acuity Scheduling.
3. Pricing and payment
Current prices (AUD)
Single session (60 min): $150
3-Session Package (three 60-min sessions): $420 (saves $30 — $140 per session)
5-Session Package (five 60-min sessions): $675 (saves $75 — $135 per session)
Gift Card (one 60-min session): $150
All prices are in Australian dollars (AUD) and are GST-inclusive.
Payment is processed securely through Acuity Scheduling at the time of booking. Acuity uses Stripe and PayPal as backend payment processors. You may optionally create an Acuity account and choose to save your payment card details within Acuity for future bookings — this is not required. Connected Heart Healing does not store your payment card details. By completing a booking, you authorise the charge to your nominated payment method.
We reserve the right to update our prices at any time. Price changes will not affect bookings or packages already paid for.
4. Your consumer guarantees — Australian Consumer Law
Our services come with non-excludable guarantees under the Australian Consumer Law (ACL). Nothing in these Terms limits or excludes your rights under the ACL.
Australian Consumer Law — Your Consumer Guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to:
cancel your service contract with us; and
a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Under the ACL, our services are guaranteed to be delivered with due care and skill, and to be reasonably fit for the purpose for which they are supplied. If a service fails to meet these guarantees, your rights are as described above.
To the extent permitted by law, our liability for any failure not amounting to a major failure is limited to re-supplying the service or refunding the cost of the affected session.
5. Session packages
Session packages are prepaid bundles of three or five sessions purchased at a discounted rate. The following terms apply to all session packages:
3-Session Package: valid for four months from the date of purchase
5-Session Package: valid for six months from the date of purchase
The expiry date of your package will be stated in your purchase confirmation email from Acuity Scheduling. It is your responsibility to book and use your sessions before the expiry date.
Extensions
We understand that circumstances can change. If you are unable to use all sessions within your package validity period due to genuine unforeseen circumstances (such as illness or family emergency), you may request a one-time extension of up to 30 days by contacting us before your package expires. Extensions are granted at our discretion and are not guaranteed.
Unused sessions at expiry
Sessions not used by the expiry date are forfeited, provided the expiry terms were clearly disclosed at the time of purchase (which they are — via your purchase confirmation email and these Terms). If you believe your package has expired due to circumstances beyond your control, please contact us to discuss your options before the expiry date where possible.
Packages and consumer guarantees
Your ACL consumer guarantee rights apply to session packages. If a session within your package fails to meet consumer guarantees, you retain the right to have the issue rectified or to receive a refund for that session, regardless of package expiry.
Packages are non-transferable and may only be used by the person who purchased them (or, in the case of animal sessions, for the same animal).
6. Gift cards
Gift cards are valid for one 60-minute distance energy healing session (for a person or an animal). The following terms apply:
Gift cards are valid for three years from the date of issue
The date of issue will be stated on the gift card confirmation email
Gift cards must be redeemed before the expiry date
After the expiry date, the gift card is forfeited and no refund is payable
Gift cards are not redeemable for cash
Gift cards are non-transferable once redeemed
Lost or stolen gift cards cannot be replaced
Gift cards may not be used to purchase further gift cards or session packages
Important: Under the Australian Consumer Law, gift cards must be valid for a minimum of three years from the date of purchase. Connected Heart Healing gift cards meet this requirement. No post-purchase fees apply to gift cards.
7. Cancellation and rescheduling
We understand that plans change. Our cancellation and rescheduling policy is designed to be fair to both clients and practitioner, and complies with the Australian Consumer Law.

Cancellation by you
More than 24 hours before your session: full refund or rescheduled at no charge
Within 24 hours of your session: a cancellation fee of 50% of the session price applies, reflecting the genuine loss of a time slot that cannot reasonably be filled at short notice. The remaining 50% will be refunded or credited at your request.
No-show (no contact made): the full session fee is forfeited. If you missed your session due to a genuine emergency, please contact us as soon as possible and we will consider the circumstances.
Cancellation fees are a genuine pre-estimate of loss from a time slot that cannot be filled at short notice. They are not penalties. If you filled the slot, any cancellation fee charged for that session will be reviewed on request.
Cancellation by us
In the unlikely event that we need to cancel a session, we will notify you as soon as possible and offer you a full reschedule or refund. We are not liable for any additional costs you may incur as a result of our cancellation.
Rescheduling
You may reschedule a session at no charge with more than 24 hours notice. Rescheduling requests within 24 hours of a session are treated as a late cancellation and the cancellation fee applies.

8. Your responsibilities as a client
To get the most from your session and ensure it can be conducted effectively, you agree to:
Provide accurate and relevant information about yourself or your animal at the time of booking and during the session check-in
Arrive at your session on time and ensure you have a stable internet connection, a working camera and microphone, and a quiet space
Inform us of any relevant medical conditions, recent treatments, or circumstances that may be relevant to the session
Continue to work with your doctor, specialist, or veterinarian for medical and veterinary care — energy healing is complementary, not a replacement
Treat Connected Heart Healing and its practitioner with courtesy and respect
We reserve the right to end a session or decline future bookings if a client acts in a way that is disrespectful, abusive, or inconsistent with these Terms.
9. Scope of practice and health disclaimer
Jodie Cruz is a certified Quantum-Touch practitioner and Level 1 instructor. Connected Heart Healing operates as a complementary health service. We do not:
Diagnose, treat, cure, or prevent any medical or veterinary condition or disease
Prescribe or recommend medications, supplements, or medical treatments
Provide medical, psychological, or veterinary advice
Recommend that clients discontinue or alter medical or veterinary treatment
Energy healing works with the body's own intelligence and is intended to support overall wellbeing. Results vary between individuals and cannot be guaranteed. Please refer to the Health & Medical Disclaimer on our website for full details.
10. Intellectual property
All content on the Connected Heart Healing website — including text, images, graphics, and course materials — is the property of Jodie Cruz or is used under licence. You may not reproduce, distribute, or use any content from this website without prior written permission.
The Quantum-Touch® name and associated materials are the intellectual property of the Quantum-Touch Organisation. Their use on this website is in accordance with Jodie Cruz's certified practitioner and instructor status.
Session recordings are not made by Connected Heart Healing. You may not record sessions without our prior written consent.
11. Privacy
We handle your personal information in accordance with our Privacy Policy, available on our website. As a provider of energy healing services, we are classified as a health service provider under the Privacy Act 1988 (Cth) and comply with all 13 Australian Privacy Principles.
Any post-session feedback or follow-up sent to you via email or text is kept confidentially and used solely for the purpose of supporting your experience with our services. We do not share your personal or health information with third parties except as described in our Privacy Policy.
12. Limitation of liability
To the maximum extent permitted by law, Connected Heart Healing's liability for any loss or damage arising out of or in connection with our services is limited to the re-supply of the relevant service or a refund of the amount paid for that service.
We are not liable for any indirect, consequential, or special loss or damage, including loss of income or opportunity, arising out of or in connection with our services.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. Any attempt to do so is void.
13. National Code of Conduct for unregistered health practitioners
Jodie Cruz operates in accordance with the National Code of Conduct for Health Care Workers as enacted in South Australia under the Health and Community Services Complaints Act 2004 (SA). As a client, you have the right to:
Receive services that are provided safely and with appropriate care
Be treated with dignity and respect
Have your privacy and confidentiality maintained
Be referred to another practitioner if your health issue is beyond our scope
Make a complaint about the service you have received
If you have a concern about the conduct of this practitioner, you may make a complaint to the Health and Community Services Complaints Commissioner (HCSCC):

14. Governing law and jurisdiction
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of South Australia, without prejudice to any mandatory consumer protection rights you may have under the laws of your own jurisdiction.
For international clients: while this agreement is governed by Australian law, if you are located in a jurisdiction with its own consumer protection laws (such as the United Kingdom, European Union, or Canada), those laws may also apply to protect your rights as a consumer.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page. Continued use of our services after any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Changes to these Terms will not affect bookings or purchases made before the date of the change.
